Manufactured Housing Board
An emergency rule 11 NCAC 08 .0913 has been adopted by the Manufactured Housing Board. The emergency rule is effective on April 20, 2020.
Emergency Extension Of Temporary License For 3 Manufactured Housing Salesperson

Reason for Action: The North Carolina Manufactured and Modular Homebuilders Association Registered Housing Specialist class and the Manufactured Housing Salesperson's test have been postponed until the COVID-19 "Stay at Home" order is rescinded by the Governor of North Carolina. Without passing the Manufactured Housing Salesperson's test the salesperson may no longer engage in business as a manufactured housing salesperson.
Code Officials Qualification Board
An emergency rule has been adopted by the Code Officials Qualification Board. The emergency rule is effective on April 20, 2020.

Reason for Action: An emergency rule is needed to automatically issue Temporary Certificates to holders of a Probationary Certificate that are to expire between March 12th and December 31st 2020. Temporary Certificates are allowed under NC Gen. Stat. 143-151.13(d).

Reason for Proposed Temporary Action: The effective date of a recent act of the General Assembly. Pursuant to S.L 2024-57, Subpart 111-G, the amendment is necessary to make 11 NCAC 18 .0102 conform with the amendments to GS 58-50A-70 contained in Section 3G.1.(b) of SL 2024-57 which allow a statewide chamber of commerce or business league meeting the additional requirements of the amended statute to form a multiple employer welfare arrangement.
The public comment period is available from January 21, 2025 to February 14, 2025. During this time, the agency will accept written comments on the proposed temporary rule prior to adoption. Written comments from the public will be accepted by mail or email at the following:

Reason for Proposed Action: S.L. 2021-161 enacted statutes for the licensure of pharmacy benefits managers (PBMs) and directed the Department to adopt rules for licensure (see G.S. 58-56A-2). Entities to be licensed as PBMs have previously been licensed or registered as third-party administrators (TPAs). Borrowing from the licensure requirements for TPAs, the proposed rules further set out the requirements for licensure as a PBM. Additionally, where G.S. 58-56A-2 give the Commissioner the authority to charge an initial application fee of $2,000 and a renewal application fee of $1,500, those fees will be established by the proposed rule 11 NCAC 24 .0102.

Reason for Proposed Action: The reason the change is needed is because of recently enacted legislation, SL 2023-133. Section 8 of this bill amends G.S. 58-56-26 so that the audit required by the statute does not have to be on-site and this would make conforming amendments to 11 NCAC 12 .0332.
